Prenuptial Agreements in Indiana
A prenuptial agreement (also called a premarital agreement or “prenup”) in Indiana is a legal contract entered into by two people before they marry. It specifies how assets, debts, and other financial matters will be handled during the marriage and in the event of divorce or death.

- Own significant assets or property before marriage
- Have children from a previous relationship

- Expect to receive an inheritance

Indiana Prenuptial Agreement Law
Prenuptial agreements in Indiana are governed by Ind. Code §§ 31-11-3-1 to 31-11-3-10. As a UPAA state, Indiana requires that prenuptial agreements be in writing, signed by both parties, and executed voluntarily with full financial disclosure.
