Prenuptial Agreements in Texas
A prenuptial agreement (also called a premarital agreement or “prenup”) in Texas is a legal contract entered into by two people before they marry. It specifies how assets, debts, and other financial matters will be handled during the marriage and in the event of divorce or death.
Is a Prenuptial Agreement Right for You?
A prenuptial agreement may be beneficial if you or your partner:
- Own significant assets or property before marriage
- Have children from a previous relationship
- Own a business or professional practice
- Have significant debts
- Expect to receive an inheritance
- Have a significant difference in income or wealth
Texas Prenuptial Agreement Law
Prenuptial agreements in Texas are governed by Tex. Fam. Code §§ 4.001–4.010. As a UPAA state, Texas requires that prenuptial agreements be in writing, signed by both parties, and executed voluntarily with full financial disclosure.
